While downsizing has been widely studied, its connection to firm ownership status and the reasons behind it are missing from extant research. We explore the relationship between downsizing and family ownership status among Fortune 500 firms. We␣propose that family firms downsize less than non-family firms, irrespective of performance, because their relationship with employees is based on normative commitments rather than financial performance alone. We suggest that their actions are related to employee- and community-friendly policies. We find that family businesses do (...) downsize less irrespective of financial performance considerations. However, their actions are not related to their employee- or community-friendly practices. Spice is also peppered throughout the Old Testament.2 The Song of Solomon recites: “Thy plants are an orchard of pomegranates, with pleasant fruits; camphire, with spikearion 28.1 spring/summer 2020 2 a vexed pharmacopeia nard and saffron; calamus and cinnamon, with all trees of frankincense; myrrh and aloes, with all the chief spices.”3 Every one of these fruits, plants and spices remained popular in the West throughout antiquity, into the Middle Ages, and beyond. As early as 3000 bc, trade routes had connected the Mediterranean to the near east. Courtesy of this “Spice Road,” ancient Mediterranean civilizations had access to a wide range of horseradishes, mustards, peppers, gingers and other spices. The Greeks and Romans had a special relationship with black pepper—so much so that four out of five recipes in Apicius’s famous 1st century cookbook4 called for a sprinkling of this sometimes-costly commodity. It is perhaps not coincidental that black pepper contains heat-producing alkaloids very similar to those found in New World chili peppers. Much has been written about the important role of chilis in South and Central American culture—a region that, by the Middle Ages, was in many respects the equal of Europe in “artistic sensibility, social complexity, and political organization.”5 The habanero and its capsainoid cousins were at the heart of the culinary and ceremonial customs of Mesoamerica, their biting heat and florid livery an apt metaphor for the “extravagant feats of human butchery”6 —very much in the tradition of the spectacular venationes of ancient Rome—for which the Aztecs at least were well known. To what extent was hot spice also a significant part of the culinary, medical and cultural landscape of the Old World? At a conference hosted by the Institute for Digital Archaeology at the University of Oxford last December, experts from Europe and North America examined the literary, historical, archaeological and scientific evidence around these questions. Their inquiry received a boost from new and rapidly developing techniques for examining the physical evidence of ancient diet and food production—laboratory techniques not available even five years ago. There was also fresh medical evidence to consider: significant research is being done in the area of chemosensation in the context of spicy foods. This Roger Michel, Alexy Karenowska, George Altshuler, Matthew Cobb 3 includes trying to understand how different so-called “TRP channels” in the nervous system process spice information— in particular, the connection between spice and endorphin levels. It appears that many of the hot spices available in antiquity could potentially trigger the same TRP channels as the capsaicin-charged Mesoamerican peppers. This creates a nice connection between old and new world spice that helps to explain and contextualize both. However, in the end, firm conclusions at the Oxford conference were scarce. It quickly became clear that more work, a greater diversity of viewpoints, better refined questions, and a change of venue were required to make additional progress. Training of resident physicians is essential for the care of future patients. While surgical trainee involvement is necessary, its disclosure to patients can often be omitted or underplayed by surgeons. The informed consent process and the underlying ethical principles make evident that patients should be informed of trainee involvement. In this review we explore the importance of disclosure, current themes in practice, and the optimal discussion for which we should strive.

The argument from the claim to correctness has been put forward by Robert Alexy to defend the view that normative utterances admit of objective answers. My purpose in this paper is to preserve this initial aspiration even at the cost of diverting from some of the original ideas in support of the argument. I begin by spelling out a full-blooded version of normative cognitivism, against which I propose to reconstruct the argument from the claim to correctness. I argue that the (...) context of uttering normative propositions points to the possibility of normative cognition, but does not constitute it. What constitutes the possibility of cognition is, as of necessity, the propositional structure of norms. I conclude that the argument from the claim to correctness ought to safeguard a distinction between the context of uttering a normative sentence and the proposition that individuates the content of the utterance. René Girard's stance towards the Western philosophical tradition was somewhat ambivalent. On the one hand, he acknowledged that major philosophers had influenced him and had contributed valuable insights on questions of desire, religion, violence, and the sacred. On the other hand, he felt that Western philosophy often, if not always, neglected the founding violence that lies at the origin of culture. George Yancy gathers white scholarship that dwells on the experience of whiteness as a problem without sidestepping the question’s implications for Black people or people of color. This unprecedented reversion of the “Black problem” narrative challenges contemporary rhetoric of a color-evasive world in a critically engaging and persuasive study.

The question of the character of constitutional rights norms is complex and admits of no easy answer. Without reducing the complexity of the issue, I attempt in this paper to formulate some clear views on the matter. I shall argue that constitutional rights reasoning is a species of rational practical reasoning that combines both balancing (as Robert Alexy admits) and the grounds as to why balancing is appropriate (deontological constraints). Absent the latter type of reason, the application of constitutional principles (...) remains a pure instance of balancing. Each time those reasons are touched upon, however, balancing becomes subject to deontological constraints. Yet deontological reasons are neither self-proclaiming nor complete. Rather they require for their articulation the background of an already operational practice of practical (legal) reasoning. This practice exemplifies what I shall dubthe structure of autonomy, that is, a set of regulative ideals, not yet definitive norms, that derive from the reflective character of human agency. This structure comes to light when one turns to the agent’s point of view – to the point of view of someone who is engagedreflectivelywith practical questions (questions about rights arepar excellencequestions of this type). The structure of autonomy is more fundamental than any deontological or teleological reasons: it is in its light that deontology and teleology need to be understood as representing merely complementary forms of argument, which can be employed in reasoning that aims to maximise constitutional rights provisions. At the same time, the structure of autonomy as a regulative ideal generatesprima faciereasons for allocating greater weight to deontological arguments in the relevant contexts of balancing. Such prima-facie reasons do not prescribe fully-fledged deontological constraints, but merely set the burden of proof in favour of specific reasons and ensure that the structure of autonomy be respected overall. Professor Georges Goriely of the Free University of Brussels has made one more valiant attempt to rescue Sorel the thinker from the reputation fastened upon him by the title of his Rdflexions sur la Violence in 1906. For most readers he has been the author of that one book, which is seldom read in the light of his other works. It is significant that Goriely reaches it only upon his page 199, barely twenty pages before his study terminates. Also worthy of note is the fact that of the over one hundred critical books and articles about Sorel which are listed in his bibliography, only two are in English: Richard Humphrey's Georges Sorel: Prophet Without Honor (1954) and James M. Meisel's The Genesis of Georges Sorel (1951). In European discussions Sorel frequently shares the company of such names as Croce, Bergson, and Nietzsche. But in the Anglo-Saxon world he has had in general a bad press, or none at all. A far-from-systematic philosopher, his writings, most of them originally articles composed in the heat of European controversies, have seemed remote from transatIantic concerns. He has been reputed "the father of syndicalism" in a country where the adjective most often applied to syndicalism is "criminal." When Mussolini proclaimed at one time that the R~flexions was his favorite bedside book, Sorel seemed to add the paternity of Fascism to his list. All that was needed to complete his damnation by labels was the dread word "anti-intellectual," and that has been freely applied to him. Nevertheless, Professor Goriely finds it possible to take Sorel's ideas seriously, quite apart from the political misuses which have been made of them. He sees that Sorel was primarily a pragmatic moralist immersed in his times and intent upon finding some way to bring about a European ricorso, a rejuvenation of classic republican ethics. At the turn of the century he saw only mediocrity and decadence: democracy had become demagogy, and industrial capitalism a mess of corruption. Sorel's great search was for a moral lever, for something dynamic, some source of energy in men which could be tapped in order to restore virtue and dignity and morale in the common man. Being imbued with historical relativism, and played upon by vigorous and contradictory influences (Vico, Marx, Bergson, Nietzsche, P~guy), Sorel steadily revised his views. It is that fact which gives his contradiction-filled philosophy the character of a "dramatic pluralism." Of one thing, however, Sorel was always convinced: intellect alone could not re-invigorate European ethics. The feelings must be stirred by something which, as early as 1894, he called a "myth." He had no use for rationally planned utopias operated by savants in the manner of Saint-Simon or Comte (whom he constantly attacked). He groped for a moving, even an "infinite" goal to be generated from history by the creative activity of men, such as the famous "general strike." A Norman like Alexis de Tocqueville, his roots were in a mixed liberal-republican aristocracy on the classic model, calling for large numbers of "social heroes" adapted to the industrial age. Torrance seeks to uncover a common "Christocentrism" within the Byzantine tradition that challenges the contemporary tendency among contemporary Orthodox theologians to "unmoor" theological anthropology from the doctrine of the humanity of Christ. Indeed, according to Torrance, some of these approaches go so far as to risk the danger of "theological shipwreck" (1). As general representatives of the tendency Torrance has in mind, we can name such figures as John Zizioulas and Vladimir Lossky, whose personalist anthropologies depart from the tradition by "bypassing or deferring Christology" (10) In the case of Zizioulas, for instance, Torrance sees the disintegration of theological anthropology into "a sentimental application or projection of worldly and hazy concepts of personality and 'community' to both the Godhead and the people of God" (10). If, for Torrance, the above thinkers appear to represent a wayward tendency (even if he takes issue with certain of their "starting points," Torrance nevertheless seems to agree with most of their conclusions), it is Fr. John Behr whose theology Torrance likely has in mind as risking "theological shipwreck."As we shall see, the overall intelligibility of Torrance's work appears only in the final chapter, against the backdrop of Behr's "unmistakably Christocentric" (206) anthropology. While Torrance joins Behr in bemoaning the non-Christocentric character of much of modern theological anthropology, nevertheless, he sees Behr's project as positing a Christocentrism that flies in the face of the Byzantine tradition. In light of Behr's Christocentrism (and in a way that is reminiscent of Gaudium et Spes §22), Torrance wishes to [End Page 373] show that, for any genuinely Byzantine doctrine, Christ, in his particular and enduring humanity, must be the starting point of the human ideal: "Human perfection and human destiny are only revealed, known, and bequeathed in the person of Jesus Christ, the God-man" (11). To this end, Torrance proposes a "fresh Christocentric paradigm" (3).Torrance's study provides insight into important texts which both implicitly and explicitly reflect the priorities of the Fathers. Taking the historical and systematic approach of Georges Florovsky's "neo-patristic synthesis" as his cue, Torrance highlights the centrality of Christ's humanity in four key figures. He examines the immovability of the human will in the eschaton in Maximus the Confessor (ch. 2), the particular ("depictable") and enduring humanity of Christ in Theodore the Studite (ch. 3), the attainability of human perfection in Symeon the New Theologian (ch. 4), and the possibility of deification through uncreated grace in Gregory Palamas (ch. 5). In each of these thinkers Torrance discovers a "thoroughly Christocentric gaze" (37), which begins from the concrete and particular human nature of Christ, and thereby provides a contrast with the abstract tendency of certain contemporary Orthodox thinkers. However, as we shall see, on account of the ambiguity surrounding the term "Christocentric," it is not always clear whether or how Christ's humanity and human perfection figure into the themes discussed. More problematically, it is not always clear whether Christ's perfect humanity provides an insight into human perfection or human nature, as such.For the purposes of this review, we will focus on Torrance's chapter on Theodore the Studite. Torrance's treatment of Theodore is distinct from his treatment of other Byzantine figures inasmuch as Theodore's teaching on Christ's depictability is historically situated in an explicitly Christological debate. While the studies on Maximus, Symeon, and Palamas certainly have themes that, in one way or another, advert to Christ's humanity, nevertheless none of particular issues treated can be said to have Christ's humanity as their essential starting point. Robert Alexy’s theory of legal argumentation is among the notable contributions made to mainstream jurisprudence in the last three decades. Remaining true to its rational discursive mission, it engages with both analytical positivism and natural law theories. A recent collection of essays edited by George Pavlakos explores Alexy’s theory from a number of philosophical standpoints, revealing its theoretical potential and flaws. By doing so, this volume helps us to gain a better understanding of the implications of Alexy’s theory of (...) legal argumentation, but also to identify new areas of research within the discourse theory of law. Although this collection is concerned with a critical examination of various aspects of Alexy’s work, it nonetheless draws attention to the dual characteristics of positive law, that is, the problematic separation of facts from values, law from morality, legal certainty from justice, which continue to preoccupy legal theory. In what follows I shall attempt to examine the debate between Alexy and the contributors to Pavlakos’s volume in order to gain a deeper understanding of the role of dichotomies in legal theory. Part 1 starts by explaining the theoretical background against which I have read the debate on Alexy’s theory of legal argumentation. I have explored the role of dichotomies in socio-legal research elsewhere. However, in the following pages, I shall use Alan Norrie’s critical examination of antinomies to throw light on some of the shortcomings of Alexy’s theory and also to discuss the concerns of mainstream jurisprudence. In that sense, this essay presents both Norrie’s and Alexy’s works, using the former to critically assess the latter. In Part 2, I briefly sketch the layout of Pavlakos’s collection to provide an overview of the type of questions that are discussed by the various contributors. Parts 3 and 4 bring into focus two issues that loom large in the collection. The first issue is Alexy’s central thesis on law’s claim to correctness, while the second concerns the duality of law exemplified by the attempts of mainstream jurisprudence to cope with the tension between the positivist notion of law and the idea of justice. It connects these topics by arguing that to have a free mind, a person must be willing to follow his thoughts wherever they lead, and that this just isn’t possible if the person thinks that some thoughts are morally off limits. Value pluralism is the idea, most prominently endorsed by Isaiah Berlin, that fundamental human values are universal, plural, conflicting, and incommensurable with one another. Incommensurability is the key component of pluralism, undermining familiar monist philosophies such as utilitarianism. But if values are incommensurable, how do we decide between them when they conflict? George Crowder assesses a range of responses to this problem proposed by Berlin and developed by his successors. Three broad approaches are especially important: universalism, contextualism, and conceptualism. (...) Focusing on political and interpersonal conflict in the U.S., particularly racial conflict, but with an eye to similar conflicts throughout the world, we argue that the enactive approach to mind as life can be elaborated to provide an exigent framework for present social-political problems. An enactive approach fills problematic lacunae in the Western philosophical ethics project by offering radically refigured notions of responsibility and language. The dual enactive, participatory insight is that interactional responsibility is not singular and language is not (...) an individual property or ability, something that someone simply and uniformly 'has' or 'controls'. These points have not been integrated into our self-understanding as moral actors, to everyone’s detriment. We first advocate for adequate appreciation of Colombetti and Torrance’s 2009 suggestion that participatory sense-making necessarily implies shared responsibility for interactional outcomes. We argue that the enactive approach presents open-ended cultivation of virtue as embodied, contextualized, and dynamic know-how and destabilizes an individualist metaphysics. Putting this framework to work, we turn to the interactional challenges of conversations that concern differences and that involve potentially oppositional parties, offering a reading of Claudia Rankine’s Just Us. Finally, we make explicit Rankine’s normative project of mindful navigation of multiple perspectives in an interaction. We abstract three interrelated spheres of participatory intervention: location, language, and labor. These also indicate routes for empirical investigation into complex perspective-taking in dynamic interactions. (shrink)

ABSTRACT The list of proposed addictions has recently grown to include television, videogames, shopping, day trading, kleptomania, and use of the Internet. These activities share with a more established entry, gambling, the property that they require no delivery of a biological stimulus that might be thought to unlock a hardwired brain process. I propose a framework for analyzing that class of incentives that do not depend on the prediction of physically privileged environmental events: people have a great capacity to coin (...) endogenous reward; we learn to cultivate it, and, where it is entrapping, to minimize it, by managing internally generated appetites for it. The basic method of cultivating endogenous reward is to learn cues that predict when best to harvest the reward that has been made possible by the growth of these appetites. This hedonic management occurs in the same motivational marketplace as the instrumental planning that seeks environmental goods in the conventional manner, and presumably obeys the same laws of temporal difference learning; but these laws are no longer limiting. Furthermore, instrumental contingencies often provide the most productive structure for hedonic management as well, for reasons that I discuss; but the needs of hedonic management create incentives both to pursue instrumental goals in a suboptimal manner and to avoid noticing how the hedonic incentive affects this pursuit. The result is the apparent irrationality that is often observed in process addictions. (shrink)

Scott Momaday, James Welch, Leslie Marmon Silko, Gerald Vizenor, among others—Alexie assumed the (...) pose of an enfant terrible and suggested that his elders were trying a bit too hard to produce an ultimately inauthentic sense of traditionalism. "We've been stuck in place since House Made of Dawn," he complained to an interviewer in 1997.2 Rather than presenting his readers with sick and/or depressed Indians caught between two worlds who discover healing in cultural restoration—the dominant plotline of NAR novels—Alexie's innovative characters played basketball and blues guitar, obsessed about their crushes and classes, and worried more about fitting into the modern world than healing it with some spiritual return to ancient Indian wisdom. Stylistically and thematically, Alexie was always closer to the likes of a George Saunders or Junot Diaz than he was to the serious modernists who had [End Page 27] inspired his NAR predecessors, and his political outlook more closely resembled the "identity politics" of younger Indian academics than the "sovereignty" discourses of twentieth-century tribal councils. Alexie wielded humor and pathos to great effect and always seemed to have his finger on the pulse of newer audiences, including those of us who call Indian reservations home. Alexie's influence on everyday Native American culture has been underestimated.Born to Salish parents in 1966 and raised on and off an eastern Washing-ton reservation, Alexie has published (as of this writing) twenty-six books of poetry, fiction, and memoir, much of which has been lauded for its dark humor and tender compassion in the face of serious and challenging topics—sexual abuse, chemical addiction, parental abandonment—as well as for its "reservation realism": the sense, often reiterated by Alexie himself, that his work speaks more authentically to real Indian life than most Native American works. His first published fiction was a collection of short stories, The Lone Ranger and Tonto Fistfight in Heaven (1993), followed two years later by his first novel, Reservation Blues (1995). In 1996 Alexie published his second novel, Indian Killer, which moved in a different, darker direction. Departing reservation settings for the city of Seattle and supplanting his humor with a horror sensibility, Indian Killer is about a serial murderer who scalps his white male victims and the subsequent racial tensions that arise. In keeping with Alexie's identity politics, a significant theme of the novel is "ethnic fraud"—the claiming of false Indian identity by non-Indians—a topic that received serious treatment during the 1990s and that supplies another layer of meaning to the novel's title.3 But Indian Killer is primarily about the murder of white men, and the most that anyone could say about the moral questions it raises is that Alexie seems to have left them for the reader to decide. Arnold Krupat decided to call Indian Killer a "warning to whites."4 A decade later, Alexie published two short books, each having a foothold in the lucrative young adult (YA) genre: The Absolutely True Diary of a Part-Time Indian (2007) and Flight (2007). The former was immensely successful, critically and commercially, while the latter has barely been written about at all and has not sold as well. What explains this difference? While a number of empirical studies have appeared on impaired self-awareness (ISA) after traumatic brain injury (TBI) over the last 20 years, the relative role of denial (as a psychological method of coping) has typically not been addressed in these studies. We propose that this failure has limited our understanding of how ISA and denial differentially affect efforts to rehabilitate persons with TBI. In this selective review paper, we summarize early findings in the field and integrate those findings with more (...) recent observations (i.e., 1999–2019). We believe that this synthesis of information and expert clinical opinion will inform future research on ISA and denial as well as approaches to rehabilitation for persons with TBI. (shrink)

The Modern Synthesis (MS) gene-centered population model of evolution is currently being challenged by the Extended Evolutionary Synthesis (ESS) organism-centered developmental model of evolution. The predictions of the EES are here examined with respect to the arguments of Edward Drinker Cope (1840–1897) for an organism-centered evolutionary process in which organisms both shape and are shaped by their environments such that the activities of the organisms themselves play a role in their own evolution.

Basic yet familiar and non-technical features of time are investigated. Two novel and detailed arguments are advanced defending the common view that 'time rolls relentlessly'. A number of hitherto neglected but important differences between spatio-temporal location and every other physical property are discussed. Also explored are the locations of circular time; the uniformity of nature, temporal positions and possible worlds, as well as the famous, unresolved problem, 'Why do we know so much more about the past than about the future?'. The transhumanist project of reshaping human beings by promoting their improvement through technological innovations has a broad agenda. This study focuses on the enhancement of the human organism through genetic modification techniques. Transhumanism values and a discussion of their philosophical background provide a framework to understand its ideals. Genetics and ethics are employed to assess the claims of the transhumanist program of human enhancement. A succinct description of central concepts in genetics and an explanation of current techniques to edit the (...) human genome serve to assess the capabilities and limitations of editing techniques. Potential benefits and liabilities of human enhancement through genome editing are discussed to appraise its feasibility. Ethical considerations of genome editing inform a reflection on the implications of introducing heritable changes in the genome of individuals. It is concluded that the transhumanist program is underpinned by a large number of hypotheses rather than by sufficient evidence. (shrink)
